You need only show to the IRS that you're trying to turn a profit (but not necessarily succeeding). Fortunately, that's fairly easy to do, as this article explains.
The most important key is to follow IRS rules by showing a profit in three out of the first five years. This can often be done by picking two years to stock up on most of your supplies, which will make it easier to be profitable in the other three years. Local regulations for small businesses can be confusing, but usually don't present any serious legal obstacles.
